ArtAny Terms of Service

Age Requirements

• Minimum Age: You must be at least 18 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use the Service.

Use on Behalf of an Entity

If you use the Service on behalf of a company, organization, or other entity, you represent and warrant that you have authority to bind that entity to these Terms.

Registration Requirements

Certain features require an account. You agree to:

• Provide true, complete, and current information during registration
• Update your account information promptly to keep it accurate

Account Security

• Keep your account credentials secure
• Accept responsibility for all activities under your account
• Notify us immediately if you suspect unauthorized use of your account

Account Restrictions

• Each person is limited to one account unless we approve otherwise
• Sharing, selling, or transferring accounts is prohibited
• We may merge or delete duplicate accounts

Service Content

ArtAny provides AI-powered creative services, including but not limited to:

• Text to Image and AI Image Generation
• Image to Video and Text to Video
• Video to Video and AI Video Editing
• AI Effects, AI Photo Editor, and other AI Tools
• Prompt generation and related creative features
• Community gallery, public sharing, likes, comments, and Create Similar features
• Subscription plans, credit packs, and other paid features

Service Changes

We may modify, suspend, or discontinue the Service (or any part of it) at any time. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Permitted Use

ArtAny grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for lawful purposes in accordance with these Terms.

Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, crawlers, scrapers) to access the Website or Service without permission
• Interfere with or disrupt the Service or connected servers and networks
• Circumvent, disable, or interfere with security features of the Service
• Use the Service for any unlawful, fraudulent, or abusive purpose

Content Policy

For detailed rules on generated and uploaded content, see our Content Policy. Violations may result in content removal, account suspension, or termination.

6.1 Platform Intellectual Property

All intellectual property rights in the Website, the Service, and content provided by ArtAny (including software, text, graphics, logos, and trademarks) are owned by ArtAny or its licensors. Except as expressly stated in these Terms, you receive no rights or licenses in these materials.

6.2 User Input Content

• Users and/or original rights holders retain ownership and intellectual property rights in content they input
• Use of the Service does not alter or transfer such rights
• You represent and warrant that you have the necessary rights to all materials you upload or input

6.3 Generated Content

• As between ArtAny and the user, rights, ownership, and interest in generated content belong to the user, subject to applicable law and your subscription plan
• Ownership of AI-generated content is still evolving legally; rules may change as laws develop
• Except for the limited license below, ArtAny does not claim independent intellectual property ownership in user-generated content
• You are solely responsible for all content generated using the Service

6.4 Limited License Granted to Platform

By submitting user content to the Service, you grant ArtAny a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, distribute, and display such content solely to:

• Operate, maintain, and improve the Service
• Optimize products and services
• Conduct branding and legitimate marketing relating to the Service
• Display, organize, tag, feature, and promote content that you make public through the Service, including in the community gallery, as described in Section 6.7

If you do not make content public, this license applies only as needed to operate the Service for your private use (for example, processing your inputs and storing your outputs in your account).

6.5 Commercial Use

Paid plans may include commercial usage rights as described on our Pricing page. Commercial use does not guarantee that generated content is free from third-party intellectual property claims. You remain responsible for verifying rights before commercial use.

6.6 User Feedback

Feedback, suggestions, or ideas you provide about the Service may be used by ArtAny without compensation to you, to the extent permitted by law.

6.7 Community Gallery and Public Content

Parts of the Service — including the community gallery at /image and related discovery features — allow users to browse, like, comment on, and interact with content that other users have chosen to make public. This Section explains what happens when you publish or share content publicly on ArtAny.

6.7.1 What Is Public Content

"Public content" means any image, video, prompt, model settings, style, aspect ratio, reference media, caption, comment, or related metadata that you submit to the Service with public sharing enabled, or that is otherwise displayed in the community gallery, featured areas, or other public areas of the Website. Public content may be organized by tags, categories, or filters (for example, subject matter or style labels) to help users discover works.

6.7.2 License You Grant to the Platform

By making content public on the Service, you grant ArtAny a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (for formatting or technical processing), distribute, publicly display, publicly perform, tag, categorize, index, recommend, and otherwise use such public content for purposes including:

• Operating the community gallery and related social features (including likes and comments)
• Enabling discovery, search, filtering, and Create Similar functionality
• Promoting the Service and showcasing community creations on the Website and in lawful marketing materials
• Moderating, investigating, and enforcing these Terms and our Content Policy

This license continues for as long as the content remains public on the Service, and for a reasonable period thereafter for backup, audit, legal compliance, and dispute resolution purposes, unless a longer retention period is required by law.

6.7.3 License You Grant to Other Users

By making content public, you also grant each other user of the Service a worldwide, non-exclusive, royalty-free license to access your public content through the Service and to use the Create Similar and related features to view and reuse the creative parameters associated with that content — including prompts, model selections, styles, aspect ratios, and reference inputs made available through the Service — solely to generate new content within ArtAny.

This license to other users does not allow them to:

• Claim ownership of your original public work or represent your original output as their own without substantial new creation
• Download, copy, redistribute, or commercially exploit your original public output outside the Service except as permitted by applicable law or your separate authorization
• Use your public content in violation of our Content Policy or applicable law
• Use your name, likeness, or account identity to imply your endorsement of their creations without your permission

6.7.4 Your Representations for Public Content

• You have all rights necessary to make the content public and to grant the licenses in Sections 6.4, 6.7.2, and 6.7.3
• Your public content, including any prompts and reference materials, does not violate third-party copyrights, trademarks, privacy rights, publicity rights, or other legal rights
• If your public content depicts identifiable real persons, you have obtained all permissions required by applicable law
• You understand that public content may be viewed, liked, commented on, filtered, and used by other users through Create Similar

6.7.5 Using Other Users' Public Content

When you use Create Similar or otherwise interact with another user's public content, you may only do so through the Service and in compliance with these Terms and our Content Policy. Content generated through Create Similar is new AI output. ArtAny does not guarantee that such output is free from third-party rights claims, and you remain solely responsible for your use of it.

6.7.6 Removal, Privacy, and Changes

• You may be able to make content private or request removal through account or support tools where available
• Removing public content stops new public display, but does not necessarily delete copies already generated by other users through Create Similar before removal
• We may remove, restrict, or disable public content or community features at any time, including for moderation, legal compliance, or product reasons
• Do not publish sensitive personal information, confidential information, or content you do not want others to view or reuse through Create Similar

No Warranty on Output

• We do not guarantee the accuracy, completeness, legality, or suitability of AI-generated content
• AI output may contain errors, biases, or inaccuracies
• AI output does not represent the views or positions of ArtAny

Third-Party Rights

• We do not guarantee that generated content does not infringe third-party intellectual property or other rights
• AI output may unintentionally resemble copyrighted works or trademarks
• You are responsible for verifying potential rights issues before use, especially for commercial purposes

User Responsibility

• You are solely responsible for your use of generated content
• ArtAny is not liable for third-party claims arising from your use of generated content
• We recommend independent verification before using generated content for important or commercial purposes

8.1 Payment Finality

Payments for subscriptions and credit purchases are subject to our refund rules in Section 9 and our Refund and Fraud Policy. Except where a refund applies or as required by law, payments are final once paid credits have been consumed or the refund eligibility window has passed.

8.2 Subscriptions and Auto-Renewal

ArtAny offers monthly and annual subscription plans and credit packs:

• Auto-Renewal: Subscriptions renew automatically at the end of each billing cycle unless cancelled in accordance with our policies
• How to Cancel: You may cancel through your account subscription management page or by emailing us at [email protected]
• To avoid future charges, cancel at least seven (7) days before your renewal date
• After cancellation, you may retain access to benefits and unused credits according to the plan terms described at checkout and on our Pricing page

These Terms do not affect mandatory cancellation rights granted by applicable law.

8.3 Plan Selection

Please review your selected plan (monthly, annual, or credit pack) carefully at checkout. Annual plans may include discounts and longer commitment periods. Fees incurred due to selecting the wrong billing cycle may not be refundable unless required by law.

8.4 Credits

Many features consume credits. Credit usage, rollover, expiration, and plan limits are described on our Pricing page and may change with notice. Failed generations may be refunded credits according to platform rules.

9.1 Full Refund Eligibility

• You may request a full refund within three (3) calendar days of purchase if you have not consumed any paid credits from that purchase
• Free credits, sign-up bonus credits, or credits from other orders do not count as consumption of paid credits from the order in question
• Once any paid credit from a purchase has been used, that purchase is not eligible for a monetary refund
• We provide limited free credits so you can evaluate the Service before purchasing

9.2 Non-Refundable Situations

• Requests submitted after the 3-day window
• Any consumption of paid credits from the purchase being refunded
• Subjective dissatisfaction with AI-generated results
• Chargebacks without first contacting support

9.3 AI Output Quality

Subjective dissatisfaction with AI-generated results (including style, aesthetics, or creative direction) does not constitute a service defect and is not a valid reason for a refund once paid credits have been consumed or the 3-day window has passed.

9.4 Statutory Rights

Consumers in certain jurisdictions may have statutory withdrawal or cooling-off rights. Where applicable, such rights are addressed in our Refund and Fraud Policy or as required by law.

9.5 How to Request a Refund

To request a refund, email [email protected] with your registered email, proof of payment, and reason for the request. We will review and respond within a reasonable timeframe.

9.6 Chargebacks

If you have questions about a charge, contact us first. Initiating a chargeback without attempting good-faith resolution may result in account suspension. We may submit usage records and these Terms as evidence to payment processors.

10.1 Prohibited Conduct

• Using stolen or unauthorized payment methods
• Exploiting system vulnerabilities to obtain unpaid services or credits
• Malicious refund requests or chargebacks
• Creating multiple accounts to abuse free credits, trials, or promotions
• Reselling or unauthorized distribution of account access

10.2 Enforcement

If we detect fraud or abuse, we may suspend or terminate your account, revoke credits or access obtained improperly, and report conduct to relevant authorities where appropriate.

15.1 User Termination

You may terminate your account by following instructions on the Website or contacting us.

15.2 Platform Termination

We may suspend or terminate your account or access for any reason, including violation of these Terms, with or without notice.

15.3 Effect of Termination

• Licenses granted to you end immediately
• You must cease all use of the Service
• Paid fees are not refunded once paid credits have been consumed or the 3-day zero-consumption refund window has passed, except where required by law
• Provisions that by nature should survive termination will remain in effect

Governing Law

These Terms are governed by the laws of the Republic of Singapore, without regard to conflict of law principles.

Jurisdiction

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Singapore, unless mandatory consumer protection laws in your jurisdiction require otherwise.
